What stage are you at?
Family court cases go through several stages. Each stage has different document requirements. Find yours below to understand what you need.
First Hearing -- First Hearing Dispute Resolution Appointment (FHDRA)
Usually the first court date in private law children proceedings. The judge reviews the case, considers safeguarding information from Cafcass, and may suggest mediation or a referral to a family dispute resolution service.
Documents usually needed: Position Statement, C100 application, any existing orders, Cafcass correspondence.
Directions Hearing (DRH)
The judge sets a timetable for the case and makes orders requiring further evidence, such as a section 7 welfare report from Cafcass. No final decision is made at this stage.
Documents usually needed: Position Statement, schedule of findings sought, draft directions order.
Interim Hearing
Temporary orders may be made while the case continues. Common for urgent child arrangements, residence disputes, or applications to suspend contact pending a full hearing.
Documents usually needed: Position Statement, statement of evidence, any supporting exhibits.
Final Hearing
The judge makes the final order based on all evidence and submissions. Full preparation is essential -- the bundle must include all relevant statements, expert reports, and documents relied upon.
Documents usually needed: Position Statement, witness statement, schedule of proposed orders, all exhibits, expert reports.
Fact-Finding Hearing
The judge decides disputed facts, most often involving allegations of domestic abuse, coercive control, or harm to a child. The standard Practice Direction 12J applies. The outcome directly shapes what orders can be made at any later hearing.
Documents usually needed: Position Statement, schedule of allegations (Scott Schedule), witness statements, supporting exhibits, any police or medical records.
